Prof. dr. Bastiaan Kemp is a partner in the Amsterdam office, specialising in litigation and arbitration.

Bastiaan has extensive experience in corporate law-related disputes, class actions and arbitration. Bastiaan has a strong track record acting for parties in high profile disputes before the Dutch courts and arbitral tribunals, including before the Enterprise Chamber and the Netherlands Commercial Court.
Recent matters that Bastiaan has worked on including representing:
• a market leading company active in the online food ordering and delivery market in ICC arbitration proceedings
• a specialty chemicals multinational in NAI arbitration proceedings
• an investment fund in post-M&A ICC arbitration proceedings with an European bank
• a specialist in building products in a post-M&A NAI arbitration proceedings
• the former CEO of Airbus SE in a Dutch class action regarding shareholders’ claims
• a collective of car dealers in various Dutch class actions against claim organisations relating to diesel emission devices in cars
• an event driven investor in litigation before the district court and Enterprise Chamber revolving around AkzoNobel
• a multilateral development bank in inquiry proceedings before the Enterprise Chamber
• a global leader in security technologies with shares traded in the US in inquiry proceedings before the Enterprise Chamber initiated by a minority shareholder
• a private equity fund in summary proceedings initiated against it by a (former) fund manager
• multiple global leaders in credit investing in summary proceedings against a large industrial regarding dividend distributions
• a global investment fund in restructuring litigation in the Netherlands, Germany and England, related to a plastics industrial
• acting for a shipping operator in restructuring litigation in the Netherlands
• a globally operating service provider on several liability claims in various Dutch court proceedings before district courts and courts of appeals
• the Muncipality of Rotterdam in a harbour dispute in the port of Rotterdam
• various ultra-high net worth families in intra-family disputes, including in forced exit proceedings initiated before the Enterprise Chamber
Bastiaan also sits as an arbitrator.
In addition, Bastiaan is a Professor at Maastricht University. He also holds the position of vice-academic director of the Institute for Corporate Law, Governance and Innovation Policies, is the co-editor of the academic journal European Company Law, a member of the editorial board of the Dutch academic journal Corporate Law Monthly Review (Maandblad voor Ondernemingsrecht), a Fellow at the Zuidas Institute for Financial Law and Company Law of the Free University of Amsterdam and a Member of the corporate law advisory committee of the Dutch Bar Association and the Royal Association of Dutch Civil Law Notaries and a board member of the Dutch Corporate Litigation Association.
