Vanesa Gómez, senior associate, is a member of the Banking & Finance Practice Group in our Luxembourg Office. She advises credit, payment and e-money institutions, investment firms, fund managers, crowdfunding platforms, crypto-asset services providers and other financial institutions on regulatory matters.
Vanesa specialises in the laws and regulations applicable to the financial services industry, including authorisation requirements, supervision and prudential rules, rules of conduct, consumer protection or anti-money laundering.
Before joining Loyens & Loeff in 2022, Vanesa worked in the financial regulation departments of two major international law firms in Madrid thus bringing a practical cross border expertise into the regulatory team.
Vanesa advices on a diverse range of legal matters including the authorization request for the incorporation of two payment institutions and a management company; authorisation requests for the change in control of credit institutions, payment institutions and management companies; passporting of regulated entities to provide services in other EU member states; authorization requests for the provision of services in third countries by investment firms; analysis of fintech business models to identify licensing requirements; updating T&Cs, manuals, policies, procedures and marketing materials to ensure compliance with MiFID II, PSD2, AMLD5, distance marketing or consumer protection laws; and, advising on different inspections conducted by the Bank of Spain, the Spanish Securities Market Commission and the Spanish AML authority, among others. She also advices on foreign direct investment (FDI) notifications and screening procedures.
